KUALA LUMPUR, Dec 18- Two mining companies that are feared to be causing pollution in Sungai Kelaik, Gua Musang, Kelantan have been ordered to stop mining.
Minister of Natural Resources and Environmental Sustainability, Nik Nazmi Nik Ahmad said the decision was made based on an investigation carried out by the Department of Environment (DOE) into the compliance of the two companies with the Environmental Quality Act 1974 (Act 127).
"The result of the investigation found that Syarikat Aqua Orion Sdn Bhd has carried out activities without obtaining approval under subsection 34A(3). Investigation papers will be opened immediately under subsection 34A(6).
"While for the Gua Musang Mining Company Sdn Bhd (Redstar Capital Sdn Bhd), the investigation found that the premises were not operating as there has not been any iron ore digging or processing carried out.
"Enforcement action will be taken under Act 127 if it is found that the project promoter fails to comply with any of the approval conditions of the EIA Report which is to ensure that the implementation of the project can lessen and minimise the impact on environmentally sensitive receptors.
"The DOE will also submit a letter to the Kelantan State Lands and Minerals Office (PTG) so that PTG is able to postpone the approval of the mining license renewal to the Aqua Orion Sdn Bhd Company until an EIA Report is submitted for evaluation and approval," he said in a statement.
He added that monitoring will be carried out continuously at the project site and any non-compliance under Act 127 will be taken strict legal action.
If convicted, the offender faces mandatory imprisonment for a period not exceeding five years and may be fined at least RM100,000 and not more than RM1 million.
